State laws for Notaries vary from State to State. And unfortunately, this can mean that compliance for some Notarial certificates or Notarial acts in one State may not cross State lines. For instance, Hybrid Certificates often show up in Loan Signings and Powers of Attorneys in States that do not permit a Notary to complete them. Most States put forth Notary Handbooks that tells a Notary what certificates they can use - and if they are not in the handbook, they can't be used!
Notaries who take the time to read, understand, and implement their state laws are not only a line of defense against fraud but other types of lawsuits as well. Not all States have a test that a Notary must take- which is why Unlimited Ink has their own Signing Agent Onboarding Exam to test for advanced knowledge.

Unlimited Ink Notary will only hire Singing Agents for Real Estate closings who are members of the National Notary Association, have an NNA Background check, and have taken their Certified Signing Agent Exam annually. We do this as many of our partners make this a requirement - not because we believe it makes a Signing Agent better at their job. We call this a sort of rite of passage to work in with Real Estate Closings because it's a requirement. The truth of the matter is that the National Notary Association Certified Signing Agent Exam hasn't been updated in a very long time, all of the questions are Googleable, it is open book, and it doesn't really cover what a Notary will face out in the field. Their also not set up truly to train for Loan Signings.
Why it's a requirement we can understand but have always wished there were stricter requirements for advanced training. A Notaries purpose in any type of document signing is important, but what is expected by most Title, Escrow, and Attorney offices in Real Estate Closings just isn't covered by the National Notary Association's Certified Signing Agent Exam.
What we do like is that this single requirement at least keeps Notaries aware of their duties. When Notaries take the test, they are also agreeing to the Signing Agent Code of Conduct - which is one of the greatest aspects of the Certified Signing Agent exam. This gives hiring parties like Unlimited Ink Notary the ability to write the industry standards for Notary Management into their contracts. Unfortunately, it would work more to everyone's advantage if Title, Escrow, and Attorney clients would make the certification revocable annually if they didn't follow this code of conduct. Until then, anyone you work with should really know what's in the Signing Professionals Code of Conduct and live by it. It's probably the most in-depth and universal ideals for Notaries Public to adhere to.
Another reason we work with Notaries who are members of the National Notary Association is because if something major changes in a State or that all Notaries need to know- they are connected to the largest database in the country. Information can travel at lightening speeds once the National Notary Association steps in. And because they do work hard at keeping the attention of all Notaries information and updates do travel fast!
We once had an experience in a particular State where information about RON Stamps were misconstrued, and the NNA stepped in to have the matter resolved within 48 hours with the Secretary of State. Record timing!
